I am trying to schedule a visa appointment date and VFS website doesn't show any consulate except chennai!! can somebody please let me know what should be the reason? Last week, I was able to see Mumbai and Chennai and now Mumbai is gone! Is this because no appointments dates are available or something wrong with the website. I tried using different browsers, clearing cache, etc. but no help so far. Please help me. Will really appreciate your response.

My client is trying to see if there are any possibilities to bring a graphic artist - flash developer from Phillipines, he currently works freelance and has made a big impression with his work. He has shown interest to come to US on h1b and company wants to know if they have any issues in bringing him onboard by sponsering a h1b. The issue is, he does not have college education, other than that, he qualifies excellent for a job in this company. Will he have issues in getting a h1b? Has anyone got H1b visas with college degrees but only with work experience?

You are wrong.. all the applications will go to Atlanta processing center irrespective of company's location..
Right now Atlanta Processing Center processing May 2008 priority date for clean cases....for audited cases July 2007...

I took this really lousy picture that should have been discarded
as I couldn't get a good photo out of it. I thought I'd try something
different in Photoshop anyway, I need the practice...
Here's a scaled down original of a bird taking a bath:

Hi,
Last year my husband got laid off. At that time he was on H1 visa, 140 approved and 485 pending. He applied and got AP, and then left U.S in March 2009. AP is valid until March 02, 2010.
Now he wants to get back to U.S. and try his luck finding a job before AP expires.
My question is what are his chances to be able to get in U.S considering
1)He has stayed outside of U.S for about 11 months.
2)He is not employed by any U.S company.

I have I-485 pending at NSC EB3 category with July 2007 filing date. My I-140 is approved. I am planing to quit my job and get a job in different job qualification.Hence cannot file AC21.
My wife got naturalized and after researching online, I made a decision to file new 485 with I-130,I-864 and I-131. My AP based on employment based 485 is expired and hence I applied for new I-131 through family based thus saving money.
I did not apply for I-765 (Family Based) as I had an active EAD untill 2012(Employment Based).
I am to quit my job and afraid that my I-140 (Approved Jan 2008) will be pulled and hence my I-485(Employment Based) will be denied/revoked. Since my active EAD is based on the employment based 485, it will be unusable/revoked as well.I do not want to invoke AC21. For this reason, I want to file EAD based on Family -I-485.
My question is :
1) Can I file for I-765 based on pending I-485 (Family Based IR1).
2) Since they required to submit the last EAD issued - which in my case is employment based EAD expiring in 2012, The chances are USCIS will deny it or am I to do something differently?

I'm possibly in the same situation - if the company I work for gets bought and the company name changes does this complicate the process? I would hold the same job, title and everything else? This is a real possibility we already made 1/3 of the workforce redundant last week..
Or is it that the name change or the going away of the oirginal sponsor name means a re-start to the PERM stage? This is bad timing for me as I'm about to enter my 6th year of H1B - and as I understand it I cannot start a new PERM in the last year of H1B..?
What should I do - hold my breath or can I do something in the 3 months I have left before my 6th year starts??

I was on a 5 week leave of absence when my EAD was being renewed. I'm back at work now and was thinking I will keep a 'Leave of Absence' verification letter handy just in case USCIS asks for it. Does anybody have a format for it? I am thinking of this:
Subject: Verification of Leave of Absence
To whomever it may concern:
It has been verified that XXX XXX was put on a Leave of Absence due to the ongoing EAD renewal during the period from X/X/2010 to X/X/2010. He did not receive any salary during this period.
Please feel free to call us for any question regarding this.

Finally i went for option 2 i.e. Costco, they gave 2 2x2 photo's for $4.99 plus $2.99 for softcopy.
I could have saved $2.99 by scanning the photo's with scanner.

Across Silicon Valley and the rest of the U.S., many employers are avoiding layoffs by reducing employee hours or by cutting salaries. However, H-1B visa (http://www.geelaw.com/lawyer-attorney-1054805.html)holders, and their employers, can run afoul of U.S. immigration laws if the salary is cut without a corresponding reduction in hours.
An H-1B employer must attest to the Department of Labor, that the employer is paying the H-1B employee the higher of either: 1) the prevailing wage for the same occupational classification in the same area of employment, or 2) the actual wage level paid by the employer to all employees with similar experience and qualifications for the same job. When submitting the H-1B petition, the employer must state the number of hours per week that they will employ the H-1B worker. So if the prevailing wage for a software engineer in the San Jose metropolitan area is $40/hr., then for a full-time job the annual salary would be $83,200. This would be the minimum that the employer would need to pay annually, and an employer could always pay more.
Suppose your Palo Alto employer informs you that all professionals are taking an across-the-board 15% pay cut. If the prevailing wage for your job is $83,200, a 15% pay cut would lower your salary to $70,720. If your employer started paying you only $70,720 annually while you were still working full-time, your employer would be violating the H-1B regulations, and you could be in violation of your H1-B status. However, if your hours were reduced to only 34 hours per week, then at $40/hour you would earn $70,720 annually. Therefore, an employer and its H-1B employee could properly follow the H-1B regulations by reducing the employee's hours enough to still comply with the prevailing wage. Of course, in this example, the H-1B employee would only be able to work 34 hours per week.
