My spouse and I have been notified through I-797C notice of action letter of the interview for (form-1-485, application to register for permanent residency). They require us to bring along a checklist of items for the interview including form I-864 that needs to be attached with Tax returns and W2 or certified IRS printouts.
Both of us have been in US for 15 years holding F1 and later H1B visas. The problem is that one of us (who is the dependent) has worked in several organizations without authorization. We would like to know what cause of action to take to mitigate the problem as well as the worst-case scenario in terms of our ability to obtain residency. Any advice, particularly those who know of someone who has faced a similar situation will be appreciated.

I'm a July 2007 filer going to file for my EAD for the first time. Since I'm currently on H1B, how should I answer this question
I'm applying for:
a) Permission to accept employment
b) Replacement
c) Renewal of my permission to accept employment
I think I need to go with option "c" since moving from H1B to EAD would qualify for a "c" response
Please advise.....

U R better off rescheduling your mexico appointment - its something that could be done within next 3 to 4 months for sure. The problem of rescheduled FP is, it kind of throws your case in the back and based on ASC's load, it might take them upto an year or more (think 800,000) for them to put you in again.
Its just my opinion based on my conversation with my lawyer - since we were in S. Africa and my lawyer notified me about the FP and my lawyer blurted out what I said above.

thanks gcwaiting!!! I was so worried, my attorney told me that I onlyhad 45 days, maybe he wanted his payment in 45 days......
This is to complicated and INS take a lot of time to respond....By the way do you know aproximately how long will take to receive the I-140 approval? And if there is a chance to receive a DENIED notice? I'm so wooried about all this process and alo because I don't have the best attorney in th all world, and sometimes I don't know what to do...I'm learning a lot fom this forums. Thanks Again....

I'm coming to the US for the first time on H1B. Do I need a one way or a return ticket? My travel agent told me that since I have a multiple entry visa (expiring on Oct 2011) a return ticket is not required unless I need to travel back home within one year. Could someone with knowledge about this issue help me out. I would really appreciate a reply from someone who recently landed in the US on H1B.

I am planning to visit Canada sometime in the summer, and being Indian, I need a visitor's visa.
The Canadian consulate doesn't have much information about Advance Parole holders in the US applying for a visitor's visa, and it looks like the process is the same as for F-1, H-1B holders.
I am wondering if I need to send the original AP (as a supporting document) or if a copy will do.
I can't go to the consulate in person, and have to send my stuff in the mail, or this wouldn't have been an issue.

I have been in this country close to 11 years, and have PD of Feb 2004 EB3 India, and am thinking if I could apply for EB1 through another company than my employer. I am currently using EAD to work but I recently met someone who got GC through EB1 having started the process in 2008. I am really frustrated with the EB3 progress and have no hope so was thinking of this option. I have Masters with about 13 years of experience. Just wanted to check out if any of you are having similar thoughts and if this is a possible route ?
Also , is Labor substitution still a path or has that been blocked out ?

Hello Friends,
I think many Indians might have faced this issue.We can spell same Indian name in several ways in English.
I have one friend who is ready to file I -485.
He found following issues with Birth certificate. Does USCIS rejects or REF I-485 for following reason ?
1) His mother�s name spelled differently in his Birth Certificate. (One letter is missing)
2) His wife's Birth Affidavit has different spelling for Father�s name. (One letter is different)
3) Is first name enought in Birth Certificate or it needs full name ?
Keep on good work of helping each other.

In order to do this, she will have to leave the country and apply for a H-1b consular processing. Get a new visa and come back into the county on H-1. She cannot file for a change of status to H-1 from AOS.

if your LLC is sponsoring your GC petition, then it is not possible. Your EAD will have certain conditions for employment, usually in the same line of work as the Labor Cert. Unless of course if you are a dependant EAD, then there are no restrictions on your employment opportunities.

i applied for OPT in OCT no response from TSC for a long period ,contacted international officer--she emailed TSC got response no record of such case found.
i had to apply again in DEC they cashed my check for this one so got to know my receipt number.
so i cancelled check of first application as i thought that was missing.

second application is withdrawn.
now, they came to know that check is cancelled
they put a status that fee payment rejected due to insufficient funds and ill receive a notice.
i waited for 2 weeks received a notice saying ill receive a INVOICE notice from INS dept in which i have to pay amount for that case.
NO INVOICE received and by the time i got my notice from uscis i called to INS they said u are a day late for payment--i said no invoice received so cant get back to you.
i had payed the debt -- but INS said i was a day late
it depends on uscis to decide............
1) now will my application get rejected
2) do i have any chances of refiling again (if rejected)
as i graduated in december my I-20 will expire for refiling .?

I am a registered professional civil engineer in the state of PA having an educational background of a BS from India and MS from the US in civil engineering. I got my H1B extension approved last year for its second term of three years. I have been working in the same company since my graduation and also hold an approved I-140. I am planning to visit India in March to get my visa stamping done and am concerned about the reports of valid H1B holders being returned from Newark. Do you think I should avoid Newark as the PoE?

I thought by using EAD i will save my 6 months on H, incase anything goes wrong with 485 i still hv 6 months on H left.
